Glowable Affiliate Program Operating Agreement

1. Introduction & Acceptance

This Affiliate Agreement ("Agreement") outlines the terms governing your participation in the Glowable Affiliate Program ("Program"). By signing up, you confirm your acceptance of these terms and acknowledge that this is an independent business relationship—not a partnership, franchise, or employment arrangement.

2. Definitions

  • We, us, our = Glowable Pty Ltd, based in Queensland, Australia.

  • You, your = the approved affiliate.

  • Product(s) = any item sold via our official Glowable website, excluding any future exclusions.

3. Program Purpose

You agree to promote Glowable products through your unique affiliate links. You’ll earn a commission on validated purchases made through those links.

4. Affiliate Application & Approval

To join, submit your application with details about your platform(s). We reserve the right to approve or reject any application at our discretion, and may also terminate participation at any time if your promotional methods are deemed misaligned with Glowable’s brand or values.

5. Affiliate Links (“Special Links”)

Once approved, you’ll receive your own tracked links. Only sales made via these links will count toward commissions. Incorrect formatting or broken links may result in missed commissions, so be sure everything is properly implemented.

6. Commission Only – No Other Payments

  • You will earn commission only on completed, qualified sales through your affiliate link.

  • No setup fees, admin charges, or ongoing costs will be charged to affiliates.

  • Commissions are paid monthly (after 25-day buffer, or according to terms set in your affiliate dashboard), once the minimum $50 threshold has been met.

  • No other forms of compensation will be due or payable under this agreement.

7. Qualified Purchases

A purchase qualifies for commission only if:

  • It is made via your unique affiliate link

  • The transaction is completed and paid in full

  • The order is not cancelled, refunded, or disputed
    Chargebacks, fraud, or returned items will not qualify for commission.

8. Tracking & Cookies

Tracking is done via browser cookies (typically 7-day duration). A purchase will only qualify if it’s made within the tracking window and through a valid link.

9. Your Responsibilities

As a Glowable affiliate, you agree to:

  • Promote honestly and ethically

  • Follow Australian Consumer Law and all applicable advertising regulations (including Therapeutic Goods Administration)

  • Only use approved Glowable content and branding materials

  • Avoid misleading claims, spam tactics, or unauthorised paid ads (e.g. bidding on Glowable keywords)

  • Never make medical or therapeutic claims not approved by us

10. Termination

This agreement may be terminated by either party at any time, with or without cause, by giving written notice. Upon termination, all rights to use Glowable content or branding must cease, and only commissions accrued prior to the termination date will be paid.

11. Program Updates & Modifications

Glowable may update this Agreement or the Program structure (including commission rates) at any time. You’ll be notified via email or through your affiliate dashboard. Continued participation after an update means you accept the new terms.

12. Use of Materials & IP

All branding, logos, and marketing assets remain the property of Glowable. You are granted a limited, revocable license to use these materials while actively participating in the program.

13. Limitation of Liability

Glowable is not liable for indirect, incidental, or consequential damages arising from participation in this Program. Our total liability is capped at the total commission paid to you in the prior 12 months.

14. Independent Contractor Status

You are operating as an independent contractor. Nothing in this agreement creates an agency, employment, or joint venture relationship.

15. Governing Law

This Agreement is governed by the laws of Queensland, Australia. Any disputes shall be resolved in Queensland courts.

16. Taxes & Legal Compliance

You are responsible for any taxes, superannuation, or other legal obligations arising from your affiliate income. If you're registered for GST or operating under an ABN, it's your responsibility to meet those obligations.
